My daughter's boyfriend moved in about 5 months ago. Now they have broken up and she wants him to leave. He is NOT on the lease, only she is (she lived there by herself about one year prior to him moving in) He says this is his home and is not leaving. What can she do? She needs him out as soon as possible.

After 5 months, he's established residency. She needs to evict him according to her states landlord/tenant law. No matter WHICH state, the process begins with a 30 day written notice. If he doesn't vacate by then, she needs to file an eviction lawsuit in her local court. It won't cost much, and she should get a hearing within a couple weeks - maybe sooner. Once she wins, he'll have a few days to move or the sheriff will put him out.
