I will give you the quick version of this. My girlfriend, who I have been with for about six months, had a child one year ago. The father beat her up, punched her in the stomach during the pregnancy. She left him after the first incident. His name is not on the birth certificate. We live in California, I would like to move to Arizona with her and her son. Can she move away with me? He has not been a part of the child's life up until about two months ago, he comes around for an hour maybe every other weekend. The guy has been convicted of beating up women on three different instances. He's POS, he has a history of drug abuse. Can she move away with me? His name isn't on any paperwork or anything.

If there is no court order otherwise, sure. She can move anywhere she wants to and, more to the point, take her child with her.
