I live in the state of Oregon, I want sole custody of my child which is unborn for numerous reasons, do I wait till the child is born? This is for many reasons... one the father has no job, no insurance and his past children, one was adopted and the other two he has back child support and doesn't have custody of them. He also has past charges of battery, domestic violence and numerous felonies. What is the first thing I do from here> I can't find anywhere the laws for Oregon! Please help.

Except for hiring an attorney and getting paper work ready there is nothing you can do at this point, You will have to wait for the child to be born.

** and sounding a little smart here, should have picked better person to sleep with if you did not want him to the father.

1. his job or no job has no bearing on it
2. his having no insurance has nothing to do with it
3. him owing back child support on other kids has nothing to do with it.

His criminal record may help you get him restricted to supervised visits only ( if he will even do it)

You should have no problem getting full custody, the only issue is what level of visits he would get

Actually I would recommend you do nothing! The only question is whether you have to list him on the birth certificate. So I would seek out advice from a Family Law attorney. Or you can try a local law school and see if they have a free clinic.

If you are not required by OR law to identify the father on the birth certificate, then don't. This puts the ball in HIS court to try and gain custody/visitation. He will have to go to court to do so. The only drawback to this is you can't file for Child support without identifying him. Also, if you apply for public assistance you will be required to identify the father.
