    I want her out but I want to stay
    Hi,
    I just signed a 12 month lease with my roommate.
    My parents happen to be the co-signers because we had no credit.

    I didn't realize how much my roommate likes to party. She is consistently drinking and doing drugs like it is no big deal. New Years day she didn't even show up to work to relieve me because she was hung over passed out in her bed with some guy.

    Now I want to stay in the apartment and get a new roommate cause I can't pay the bills on my own but how do I get her out legally without hurting myself.

    This is in California.

    Well first this should be posted in the Real Estate law forum. I'm requesting it be moved there.

    If BOTH your names are on the lease, you need to enlist the landlord in evicting her. Of course the landlord may not want to go through the hassle since the problems may not impact the landlord. If the landlord won't help, then you are stuck for the 12 months unless you can find someone to move in in your place and find a new place.
