I live in Oregon and I am going through a divorce. My soon to be ex is threatening to take half my insurance settlement that was from a car accident a year prior to meeting and marrying my husband. We are legally separated and I have filed for divorce. I am just now getting to settlement on the car accident, after the divorce was filed. Does my ex have a right to any of this money? We are not using attorney's yet but that's because we only had a one year marriage with no children.

If you have filed a lawsuit in order to get a settlement just how was the complaint worded? Was this filed you vs them or you AND your husbnd vs them? If the lawsuit was filed only under your name and hubby was not mentioned in the Complaint anywhre then the insurance settlement money is all yours. If you have an attorney for the settlement you need to contact him now and make sure hubby gets zero. Don't deviate from what your accident attorney tells you to do.
