I am 37 yrs old and I have always been a us citizen. I recently fell in love with a mexican and have found out that he has been here illegally for 5yrs. Now. I have also ended up pregnant and I am wondering what is going to happen to me and my baby and the father? I also want to know how I am to name the child in the hospital if the father is illegal? What do I do ? The father has never been a criminal in the usa or in mexico ever! I am also working fulltime and going to school fulltime studying psychology to become a substance abuse counslor and then finishing school out in a doctorne in mental health psychology. If anyone could give me some advise on my matter I would appreciate it greatly. Thank you.

You merely list him as the father ( if you wish) and he signs the birth certificate, same way as any father

Nothing will happen to you or child, your boyfriend ( child's father) is subject to being picked up and deported at any time, so one day he may just not come back for dinner, or they may raid your home at some point.

Hire him an immigration attorney and start working on him becoming legal

Short answer is your good standing and his lack of a criminal record don't help much here. He did not pass through the proper paperwork or inspection to enter legally, and, last I knew, he'd have to successfully leave the country without being caught, apply for a visa and wait it out... and its not a fast process. Takes years.

For help, look up local refugee service agencies. He isn't a refugee by status, but they often do work that is tied to the issues that immigrants, legal or not, face. I've been to two presentations within the last two years with lawyers who do work in this area, and it can be a confusing mess. The presentations were co-sponsered by a catholic charities group... so you might also look in that area. I am not catholic, but work with many on social justice issues as there is a long standing tradition by many who are catholic to work in areas like this. Again, no religious overtones are expressed. A hungy person is hungry no matter the color of their skin or the latitude and longitude of their birthplace.

The paperwork for a refugee to obtain their green card (for a refugee) can be a nightmare. Make a simple mistake and it can be hell to work your way back out, if at all possible. I spent four hours one day helping refugees fill out paperwork for green card status and I found it tedious and tiresome... and english is my first language. Maddening. While your guy needs different paperwork, my point is the system is tedious and difficult and sometimes blind... sometimes unrealistic. So you need help.

So... again... seek help from local refugee/immigration groups and/or social justice groups. Or, as fr chuck mentioned, a lawyer who works in this field. Ultimately, the sources I mention depend on legal experts for their information.
