my 3 year old son's father is in prison for 3 years, is he able to recieve SSI?
We are not married.
And he was never on SSI before.

I have never heard of that one. Humm... maybe one of the others will be along shortly to say.

I believe he would not be eligible since he is in prison.

On the social security website it states:
"No monthly benefits will be paid to any individual for any month any part of which the individual is confined in a jail, prison, or other penal institution or correctional facility for conviction of a felony. This rule applies to disability benefits (§404.315) and child's benefits based on disability (§404.350) effective with benefits payable for months beginning on or after October 1, 1980."
