My upstairs neighbors are horrible, constant stomping (either with or without shoes) - they like to have really loud sex, which is disgusting to listen to. The one night, my boyfriend had had enough, when they were going at it. He called the cops, this of course pissed them off and only made the noise worse. The other night for 4 hours straight I had to listen to them push, shove, stomp, & move things around none stop. I've talked to my landlord and he basically says that there is nothing he can do, even though in my lease it clearly states "TENANT WILL NOT DISTURB PEACE AND QUIET OF OTHER TENANTS OR NEIGHBORS". I started keeping track of everything they were doing, I took it to my landlord and he offered to switch my apartment to the third floor, just last week I found out that he rented that apartment out. What do I do?

First, I think it's always better to ask people to stop doing annoying things in person and politely before calling the police, but now that it's done you need to accept that you really upset these people so they have it in for you now.

I would suggest you write a letter - short and to the point - to the landlord stating, "In keeping with our contract I have asked you to intervene in the ongoing problem of excessive noise from my upstairs neighbor which appears now to be deliberate in many instances. Your suggestion that I move to a third floor apartment would have been acceptable but you've since rented that unit to another tenant and the noise problem persists, making my unit unliveable. Please advise in writing what remedy you can provide. I preffer to remain in my apartment here to avoid the expense and inconvenience of moving, but failure to address this problem in a timely manner will be considered a breach of our contract and will force me to seek housing elsewhere."

Consider talking to a tenant's rights attorney or orgainzation as well - Google tenant rights and see what comes up in your area and find out what you need to do to legally break your lease.
