I live in Sacramento, CA . Married for 8 yrs. My husband is having an affair with a prostitute outside of the country. He's currently not working. We both do not want divorce. We both do not have any family members or relatives living in CA. His mother have a serious medical health condition, the only family member we have. My husband is travelling outside the country frequently to see his mistress. I work 11pm-7am, I do all household responsibilities,I'm taking care of the child mostly.My husband only watch the child before I go to work at night. The child is just asleep all he have to do is to be with the child. My problem is every time he travel outside of the country, Nobody will watch the child at night while Im at work, Nobody will drive him to school since I do not drive. Can I file for Joint custody for minor child without a diorce? What legal step shoild I do?

Filing for joint child custody while married/not divorce. This will affect my legal rights/benefits as a legal wife? Such as my husband social security benefits, as a beneficiary, annuity , Paid on death bank accounts, properties.

I don't understand, why would you file for custody? If you're both still married then you already have custody

There is nothing you can file for which will force him to be a better husband and father, if that's what you are asking.
