    One Year Wait
    My husband has been left a cash inheritance from an Uncle. His Uncle lived in PA. We live in NC. An Attorney is handling the distrusments. We understand that PA makes you wait for one year and then you file to the IRS. Does anyone know how long it takes for the IRS to inform the attorney of the taxes due?

    The attorney should know the percentages, the IRS does not tell them, they file the estimated taxes from the amounts,

    If this is very much at all, I would hire my own attorney to represent my interest.

    Most estates usually take one year to be probated, to give any potential creditors time to make a claim against the estate. That is a LEGAL limitation, not one that originates with the IRS.

    Do you know if the fact that he is 100% disable and handicapped and that this money will help to take care of his needs would have anything to do with the taxes. Should the IRS be informed of this when filing?

    First please don't use the comments feature for Follow-up. Use the Answer options instead.

    His disabled status will have nothing to do with the taxability of an inheritance. Taxes are paid by the estate, not by the heir. So whatever he gets from the estate would be free of taxation from his standpoint.
