Can I change jurisdiction to California since I live here now and his father lives in Boston neither of us live in Georgia anymore
Yes so long as you have lived there long enough to qualify as a resident of the state.
The case is still ongoing I have a final hearing set for November 15th I have been in ca for the last 8 months is it to late to change the jurisdiction to ca? If not and I file here in ca how do I stop the case in Georgia?
You would be forced to withdraw the case in Georgia inorder to move it to California. Since its this close why not let it proceed and wait until your next issue before trying to change anything.
Your less then 3 weeks away.
Is the judges decision in ga final or could I appeal and refile in ca after his decision?
Its final.
How would I go about withdrawing the case from ga and moving it to ca?
You would have to fill out the paperwork for withdarwl. But also you may not have time because the other parties would have to be notified also. Why do you want to change it at such a late date? Have you done mediation or anything? Do you have an agreement already in place?
Had mediation yesterday and the other party will not agree. Guardian at litem changed the mediator without notifying us and replacing him with someone she chose.
For follow-up questions it would be best if you refrained from using the "comment" feature.
The Georgia decision will, in due course, be final and appealable. But appealing does not make the Georgia case go away. So you wouldn't be able to re-file in California because there is already a Georgia case pending. Whatever grounds you may have to appeal must be enough to reverse the trial court in any event. Have you asked your Georgia attorney these questions?
