#1 he violated his Probation. He could be remanded to jail on that alone. Driving without a valid license itself is an offense that can carry jail time.
He better find the money for a good lawyer.
Which state? All I know is that here in Oregon, if you are convicted of a DUI (first offense), and get caught DWS (Driving While Suspended), it is a DWS misdemeanor but does not affect the terms of the probation in other ways (such as receiving a prolonged suspension). There is a fine, and of course, the additional record. I do not believe there is any jail time, but I am not positive about that. This is by comparison of getting caught DWS for other, more minor, offenses in which case it would just mean a DWS violation. Also, it could be worse if the person is a habitual offender. But all of this is just in my state. I don't know how much the laws differ state-to-state or where you live.
