Hi am in california - in an appt- was behind in rent signed an agreement with my landlord to avoid eviction- with a payment plan- unfortunately my situation has changed- i am on workers comp/state disability which has drastically changed my income- the manager didn't even think it was going to court and i did explain my situation to her- unfortunately the company that owns the place obviously has different thoughts- what do i do? Unfortunately, if you don't have rent money, they'll throw you out. I don't think the state will help. I don't think workers comp will help. I don't think state disability will help.

I think a cheaper place will help.

Yes, the eviction process under law is very clear, I would look for a place to stay that is within your current income levels. You will have to be served with eviction notice and have a court hearing on the eviction.

Yes workers comp can take a long time, I took over 8 years to reach a settlement from a serious accident, and sadly lost my house, car and almost everything else in the process of not being able to work and not having any money coming in.

The best I can say is show up in court with any documents possible, the court may allow you a continuance if you show them your attorney is out of town.

You need to talk to an attorney or legal aid that knows CA L-T law - not a disability attorney.

Your landlord can get you out in as little as 3 weeks. If you landlord starts the process now, he can get you out; have the unit rehabbed and back on the rental market in time for the spring rental season.
