Did the driver's airbag deploy? Were you wearing a seatbelt?

Whether you have a case also depends on whether you can show that your injuries would be less severe if the air bag had deployed. For example, if the car is equipped with only a front air bag, and the accident involved being struck from the side or from behind, then the air bag may not have helped even if it did deploy.
