Kicking out a roommate in FL
To make a long story short and not list every reason, I need my roommate out. I own and live in a house with three other people and one of them has been nothing but a pain and now I want him out. I verbally kicked him out on September 23 and told him to be out by the end of October. He has only been living with us for around eight months and is not on any kind of lease, which if I've read things correctly means he's a month to month tenant.
He has refused to pay rent this month, has not done a single amount of packing although he claims that he has found a new place and he has also told me to my face he will not pay and stay as long as he likes just to piss me off. Am I really to believe that even though he's not on any kind of lease and not directly in possession of the property (since I still live there) that I will still have to go through the courts to have him evicted? I don't care about getting money from him or damages that he caused, I just want him out of my house.
He is not on a lease of any kind and he occupies one of the three bedrooms. I believe that since he has not paid rent for this month, would that not mean that he is not a resident either and I should be able to have him kicked out for trespassing? Is there something I can do as a homeowner that doesn't involve having to go to court and paying all those fees attached to it?
