    Depending on your State and the expertise of your Attorney (and hers), yes, you could lose a portion of your pension.

    In most states, pensions accumulated during a marriage are divided at the time of divorce. Your wife may be entitled to one-half of the benefits that were earned during the marriage. Good news is that with you only being married only a year, it should only minimally affect you.

    Get a really good lawyer. If she's wanting the divorce as well, your lawyer may get her to waive her rights.

    A person cannot waive his or her rights. If she is entitled, she is entitled - no way around it.
