    I got upet with a hotel clerk and threw my credit card at her, I apologized because I realized it was wrong, do they arrest you for this, it's on the camera, and it was in Nevada, they escorted me out of the hotel, I live in California,and it was in Nevada, they were just really being mean, and I finally said "fine" and tossed the card. It was wasn't hard or anything, and there wasn't a scene or anything, I know I shouldn't have, and I told them I was sorry and also, called them

    Technically it's a battery (a crime), but I don't expect they will do anything more than what they have already done.

    If it's already done and over with, odds are you're not going to be prosecuted. If they escorted you from the hotel and left it at that, I'd stay away from the hotel and leave it alone.

    And it would be assault, not battery.

    The clerk never experienced any physical harm, which is what battery is defined by. That's what I based my statement on.

    Hello again, this:

    Battery is a criminal offense involving unlawful physical contact, distinct from assault in that the contact is not necessarily violent. Assault is a crime of violence against another person.

    That's why they have lawyers - to figure this sh*t out.

    So maybe some could explain why this isn't assalt. Physical contact was not made or attempted but and object was thrown in anger, sounds like assalt to me.

    It's probably both. I said battery, but could have said "assault and battery". The reason I chose not to is that the pair of words is over-used.

    If the card hit the clerk, it would be a battery. No harm need be experienced.

    If the clerk saw OP throw the card, it would be an assault as well.
