Am hoping that upon sentencing of a 2nd felony dui, that judge can order a person to move to California on the day of release w/o waiting form probation. Is this possible if the person has no where to go in Utah and has family and support in Calif?

Hello d:
No. The judge does the sentencing, and the county or the state takes care of confinement...
The prisoner CAN make a request for his probation to be transferred, though, and he doesn't have to WAIT till he's released. He HAS a case worker who can advise him how to do it.

Thank you for the response. Will check on the case worker. She gets sentenced next month and lost everything in Utah.

A judge can't order anyone to move anywhere. That would violate constitutional rights.
Which I guess of course is one issue, they can't order you to move, but they can order you not to move unless you get permission to move. ( i.e. not to leave the state without permission)
