I'm not sure what your question is.

You cannot "order" your spouse out of the house, if that's your question. He has as much of a right to be there as you do. If he is violent or abusive then get a restraining order which will keep him out of the house.

You would file for divorce and ask that he be removed from the marital home and that you be allowed to stay.

So file for divorce or you move out and leave him. You can not force him out of the house whlle you are married
