My insurance company settled a claim against me whereas I tapped a car at a red light. The lady got out and started pointing to damage that was already there and the police officer reported he saw no problems. She started limping when the officer and ambulance showed up. They checked her out and she was fine but she refused to go in the ambulance. Now, 7 months later she is trying to sue me personally. I think this is extortion and I have no money. What can I do and is the auto insurance company still responsible to represent me since it pertains to this? There weren't any witnesses so if this person suddenly shows up with some can she be proven to be perjuring herself? Also, what about pre-existing problems she may have had - can a doctor get away with going along with someone he may know is lying? Also - in retrospect there is a 50/50 chance that she backed up into me. I don't follow closely - looked down at cell for one moment and then I felt the tap. Is it too late to bring this up? She has access to my home address and I live in a decent middle class neighborhood and suspect she has checked my neighborhood out looking for money. I am so distressed about this - cannot afford an attorney as I am doing any 1099 work I can right now and my husband's job has cut his pay permanently.

Just turn it over to the insurance company, first she may have already signed a settlement with them, if not, they will handle any additional claims.

Don't talk to her about it, and yes you were following too closely if you hit her, at least to close to be looking at a cell phone. So you are at fault, that is not even a issue at this point.

Just breath, calm down, don't talk to her or anyone from her on the phone, turn it all over to your insurance.

Have you actually heard from her lawyer regarding a lawsuit ? This is all after the fact as far is she is concerned and unless her injuries were in the police report, then I don't think she has a case against you. Your insurance claim has been settled in her favour, I assume, so I don't think she has any further legal standing to sue you for personal injury.

She sounds like a nutcase

You say your insurance company settled. Settled what? Damages to her car, your car? Personal injury? Pain and suffering?

Why do you think the Doctor is lying, going "along with her" about pre-existing injuries? This is a harsh accusation and unless you have proof I wouldn't repeat it. If the woman was hurt and has medical documentation, no one is lying.

Please - you looked down at your cell phone and don't know if you "tapped" her or if she backed into you? I'm not even going to address that. It's not like I haven't heard that one before.

You admit you looked down. Whatever happened after that is your fault. It's your fault if you hit her; it's your fault if she backed into you. You are supposed to be paying attention to driving, not texting.

Turn it over to your insurance company. If she's injured and can prove it she will collect.

In the meantime take a deep breath and make certain you don't talk to her insurance company, don't make accusations you can't back up.

Report it to a person of higher authority.
