What can I do about someone trying to lie and extort money from my via a law suit?
My insurance company settled a claim against me whereas I tapped a car at a red light. The lady got out and started pointing to damage that was already there and the police officer reported he saw no problems. She started limping when the officer and ambulance showed up. They checked her out and she was fine but she refused to go in the ambulance. Now, 7 months later she is trying to sue me personally. I think this is extortion and I have no money. What can I do and is the auto insurance company still responsible to represent me since it pertains to this? There weren't any witnesses so if this person suddenly shows up with some can she be proven to be perjuring herself? Also, what about pre-existing problems she may have had - can a doctor get away with going along with someone he may know is lying? Also - in retrospect there is a 50/50 chance that she backed up into me. I don't follow closely - looked down at cell for one moment and then I felt the tap. Is it too late to bring this up? She has access to my home address and I live in a decent middle class neighborhood and suspect she has checked my neighborhood out looking for money. I am so distressed about this - cannot afford an attorney as I am doing any 1099 work I can right now and my husband's job has cut his pay permanently.
