Is there a reason your husband would not evict them ?

He can hire you as his agent to act for him, he can give you a POA to act on his behalf. You can not make the choice but only act for him as the owner of the property.

Normally in most areas you can , but if the tennants are smart, they may challenge your right to evict, which could cause the court to make you start it all over if you can not prove in court your right to act for husband
