    Taking ex off car note
My boyfriend and I bought a car together. We have since broke up. I am wondering if it's possible to get his name transferred off the title and lien? What do I need to do to get this done? I have the car and he doesn't want to make any more payments on it. Any advice would be appreciated.

    Hello reggae:

Cars aren't registered and titles aren't issued to two people. Banks also don't lend money to two people buying a car. Only ONE of you is the registered owner of this car. If it's YOU, then you don't need to do anything. If HE'S the registered owner, then he needs to sell the car to you and you need to get it financed.

I believe I am the first name on the title. Does that mean I am the registered owner? The bank used our combined incomes to finance the car. Sorry to be dense on this matter, but am still a bit confused. Thank you for your post excon!

He may have cosigned the loan or be considered a co-borrower. In either case you really don't want his name off the loan. The title is a different story. If his name is on the title, then you would have to go to the DMV to issue a new title. The DMV will tell you what forms you need.

Scott, That makes sense. Since the bank still has the title. I can't take his name off until the car is paid for right? Thank you!

Banks don't hold title on cars, at least not in NY. They may file a lien against the title, but they don't physically hold it. When I paid off my car loans I got a letter of statisfaction from the creditor.

Not sure how it wqorks in Montana, so I would contact your local DMV.
