Cody needs to know, there is no excuse for this, since he should have a different last name.

You will have to search for bio father, according to court requirements, and if not found, it will have to be published in the newspaper as a form of service. Child will need to appear in court and judge will also may want to ask him if he wants to be adopted ( may not, but may)

You are not going to do it without the boy knowing about it.

First, most states require you be married for a step parent adoption.

Your best bet is to hire an attorney who will prepare the papers and advice how to deal with terminating the father's rights.
