After my son was born, all me and his father got done was the paternity test. His name was put on the birth cerficicate, there is no visitation set up except of when he calls and wants to see him he did. He has not done so in the past nine months. So my question is if something happened to me and I died, would my son automatically go to him even though all we got done was putting him on the birth cerfticate or is there a way that I can have a say so on where my son would end up and who with if I died.

Even if not listed on the birth certificate he could go and prove paternity.


But yes he would get custody because he is the father, and no there is nothing you can do about it.
