We need to know if my fiancé can get his support order terminated. All the mother does with the money is buy dope for herself and her junkie boyfriend. The kids don't see a penny of that money. My fiancé broke his back in a car accident in 2005 and he has an implanted defibrillator in his chest because of his severe chronic heart disease. Ohio CSEA has been making him pay $285.55 per month for the last two years even though he's been unable to work. He is currently $4000 deep in arrears. He narrowly avoided jail the whole time he was applying for SSI benefits. Last month, he got his SSI award letter. Is he now exempt from having to pay child support in Ohio? Can CSEA or the courts force him to pay?

SSi or SSD ? If SSD did he also apply for the children as well ? Has he gone to court for a modification yet and if so how long ago?

Has he went to court to lower his payments due to this income.

And if the kids have it so bad, why has he not gone back to court to try and get custody ?

Chuck, you should know better than that, your thinking logically and reasonably. ;)

Reading the OP, of course the same questions occurred to me. Yes its true the court system has its problems. But if a father can prove his income has been reduced, he should apply for a modification. And, if the mother is a junkie and not caring for the children properly, then why has he not tried for custody or, at least have CSEA investigate and remove the children.

To answer the OP's question, no disability is not exempt from child support.

But the claims made by the OP are hardly credible. I suspect there is a lot more to this story.

The sooner he adds the kids onto his SSD, the sooner he won't have to pay child support. BUT he will still owe for the arrears. The sooner he acts, the sooner he'll be getting out from under the arrears getting bigger.

Also, the child support money is not required to be accounted for (sadly) on just how the receiving parent decides to spend or squander the money. Call Children and Family Services and report this woman's actions. Maybe if they have enough paid personnel on staff they can go out and do an inhome investigation. Lately there is no money for such investigations unless there is physical abuse to the kids so don't expect them to just jump when you call them as the $ is not there any more for investigations.
