    I-130 - do I have to be in the UK?
    My husband is an American citizen and resident. I am a UK citizen and resident, and visit him on the Visa Waiver programme. I know the I-130 form asks whether the beneficiary is in the US at the time of application. Does it make any difference to the processing or outcome whether I am or not?

    You cannot enter US on Visa Waiver program and change status to PR. Your visa interview will be conducted in UK.

    Thank you, lawanwadee. I understand this - I would return to the UK within 3 months. I'm just wondering whether it makes any difference where I am when the application is made.
