    Minor damage report- How to prove fault?
    I was in an accident on the interstate last week. Traffic was at a standstill and I was at a complete stop when a SUV hit me from behind, pushing me into the car in front of me. When the cop showed almost an hour later to take the report, she determined that it was only a minor crash and gave us a report for minimal damage (less than $400) which only lists the location and the drivers involved. It really didn't make sense at the time because his bumper was almost off his car. No one received a ticket either. When I talked to the insurance company of the guy who hit me, they said they were waiting on the report in order to determine fault. If there's nothing in the report, am I in a situation where it's he said, she said and hoping he doesn't lie to his insurance? Shouldn't he have received a ticket?

    Cops often don't give tickets in crashes like this, even if it seems obvious who was at fault, since they didn't actually witness it. But they do submoit an accident investigation report, andt hat can be pretty good evidence for you. The insuranvce cd cxompany will get a copym and you can get ne too, but there may be a fee involved.

    Something to consider: you may want to work all this through your own insurance company. It can save you the hassle of having to fight the other person's company yourself, and if you are not at fault your rates should not go up. If you haven't altready done so, you need to call your own insurance company to report the accident, and you can discuss with them whether having them pursue it on your bahalf is good idea.
