    Delinquent property taxes not included in refinance
    I refinanced with HFC in the state of Indiana. Property taxes were delinquent. HUD does not show taxes paid. The title report said no taxes were due and HFC went with that information. The paperwork was signed and within a month, HFC was sending me letters telling me I was behind in taxes and with in 4 or 5 months getting tax sale letters. The county tax records show I was deliquent but HFC still completed the mortgage. I have a written correspondence with HFC that they would not do a mortgage with outstanding property taxes... My question... since the title report is in error, is it actually a valid document to use as tax payment proof? Since HFC left the outstanding taxes out of the final funds, do I indeed have a valid contract with this mortgage?

    This is a LEGAL question which should be addressed in the LAW forum.

    Tax-wise, you still owe the property taxes, and, eventually, the property CAN be confiscated and sold if the taxes are not paid.

    Did you purchase Title Insurance? If you did, then put a claim in with the insurer. But you will still owe the taxes.

I have spent months getting the run around from HFC and have been in this refinance since 2006. I have been behind in taxes since the refi.

    Yes, you have a valid contract. The mistake was made by the title company and they are going to have to do whatever is necessary to protect the lender. That is the purpose of the title insurance policy. That means that they will pay the taxes if you don't and then they will sue you for reimbursement. Not only will you be responsible for paying the taxes, interest and penalties, but you will also have to pay their court costs and legal fees. I suggest that you get this worked out immediately before you incur additional costs.
