In foreclosure in FL from Deutsche Bank as Trustee for Ameriquest. Original mortgage was with Option One, then refinanced with Ameriquest. Both mortgages recorded and the Assignment from Ameriquest to Deutsche as Trustee. However, when Option One recorded the Release of Mortgage, the Instrument, Bk & Page actually refer to the Title Affidavit and not the mortgage. Doesn't that mean that Ameriquest is actually in second position on this loan with no legal right to foreclose? The loan is now being serviced by AHMSI which is owned by W.L. Ross, who also bought out Option One. I have requested twice, in writing, from AHMSI who they are servicing the note for, but do not get a response. Negotiating with them is impossible. Any ideas on this discovery of Option One's filings?
