Why do you want to bother with trying to take away someone's rights if they're not even bothering to exercise them? Are you trying to eliminate him from the child's life completely?

You could file with the court and explain that the father isn't exercising his visitation rights but odds are he'll come back and accuse you of interfering with custody. Courts are reluctant to remove a parent's rights to their child unless there is grounds - if you can prove that your ex is somehow harming, neglecting and/or abusing the child, then you'd have a better chance of having his rights taken away. Otherwise, I'd let sleeping dogs lie.
