    Violating Probation Jail Time Misdemeanor
    Hello, I am wrting because I have corrently violated my probation for not reporting nor paying my fine. My charge is driving on suspended license, d.o.c, and seatbelt violation. I currently have a warrant for my arrest and I do not know what to do I have tried talking to my p.o. but she is asking for me to pay the whole fine off in order to drop the warrant. I have no clue of what to do but turn myself in but I am a single mother of two and my people want my kids just because of my past problems with trying to pay my probation instead of trying to help me they are trying to take my kids all because of this. I do not have a job I currently attend college and my kids are four and seven. I have been having trouble trying to find a job and trying to find sumone to help me with my kids for me to do community service for my probation and the weekend jail time that they were askn for me to do... I have no one that will watch them while I do my time even through I do not know how much time I will have to do if I turn myself in. I just want to get this over with but I am not about to give up my kids to no one for my issues they do not deserve to be without their mother.. I got this charge due to I didn't follow the rules on my drivers permit to go back and fourth to school because my son was running a fever and I went to the store in my car after time to get medication and forgot my seatbelt den got pull over in the store parking lot.. Can sumone please help me cause I am so confuse don't know what to do nor the out come if I turm myself in or is there anything that you may suggested that I may can ask the judge or my probation officer to do to stay home for my children.. Please someone help me please.. I need to know all the advice I can get right now cause I don't have too many options right now and I really want this over with before the holidays get here good..

    To figure out what your possible punishment might be you need to find your original sentencing paperwork. This will contain the penalties should you violate your probation. Basically the Judge does not care about your being a mom. That should have nothing to do with you reporting in to the PO or paying your fine. And as for you attending college, well, it seems that you do find someone to watch your kids while you attend college so the part about you not having someone to watch them while you do community service will fall on deaf ears. And also if you DO attend college via the internet that may be a different answer.

    How do you support yourself and your kids if you do not have a job and attend college? The Judge will certainly ask you that question.

    Basically there is no excuse for NOT showing up at your scheduled appointments at the probation office. Lots of people drag their kids along to the probation office. They just wait in the waiting room while mom or dad goes into the inner office. So you can see that excuse is not going to fly.

    Basically you are going to have to figure out just what to do with your kids if you have to spend some time in jail. Also the at home monitoring entails an ankle bracelet system and there is a monthly charge for this privilege - it's not free. Some counties can charge $150 a month for this monitoring system. Some more, some less. If you do get to stay home versus jail time just how are you going to pay for this if you can't pay your fine? I have never seen where someone gets home arrest where they did not have to pay for the monitoring service. And you are not allowed outside of your home unless you get prior approval/permission from your PO otherwise you will instantly go to jail. You are given a schedule of when to go grocery shopping, etc. and you must save your receipts to prove that you were indeed out grocery shopping. You can't just leave anytime you wish on home arrest. You must be home ALL the time. If for instance your mailbox was beyond the reach of the monitoring system you could not retrieve your mail until your preapproved time to leave your home or you would be picked up by the police.
