    Separation
    I got married in November last year, live 2 months with my husband. He was a totally different person once we lived together. He gambled and drank excessively. I left my home to due to my life becoming unbearable, he in the interim lost his job. He promised me on numerous occasions that once he gets employed we will reconcile. Nothing happenened, he avoids my calls and has caused me months of pain. He has got another job which pays him a good salary. I now want to sue him for my pain and his breach of promise

    Only 2 months... file for a divorce or an annullment. What breach of promise was there? He prommised to marry you and he did. As far as pain... sorry, you can't sue for that, if that was true half the women on the planet would have been sued (or half the men). That's what a divorce is. However, since this is an international site... it helps to know what country and what state you live as laws and legal obligations vary greatly.

    Thank you for your answer, but when I moved to my parents home he promised to reconcile after he had found a job.

    There are promises and then there are promises...

    IF there was a promise to enter into a contract for sale of a building, and moneys were spent before the contract stage and the seller backs out right before an actual contract was drawn up... that might be a breach of promise that can be sued for... (no guarantee of collecting a dime however), but a promise to reconcile isn't much different than promising to visit your family for a week next year and next year changes his mind... its a broken promise, but not one that rises to a level that can be sued over.

    I think both of you realised the other isn't what they expected. Personally (this is only my opinion), I think you should both count your blessings you only wasted 2 months of your life before you found this out. I assume the engagement was brief (and this isn't the right forum for that specific discussion anyway).

    You never said what country and state you live so nobody can guess what you might be owed if anything.

    OK... that would require the input for someone familiar with South African laws on the topic. I have zero knowledge about how the subject is handled in South Africa.
