My husband and I are not together but we still live in our home. I am not on the mortgage but my name is on the deed. The court suggests that we sell the home. He is willing to move out until the divorce is final but who gets the home. I can't pay for it. Can he be made to pay the mortgage for me forever?

No, he can't be ordered to pay the mortgauge forever. There may be some temporary support ordered at best. But ultimately its your responsibility too. You most likely need to sell and get away from it.

He may agree for other considerations to let you have the home if you talk over the mortgage, and get a new loan.

But most likely the court will want it sold, so you both divide any profit after loan is paid off.

If you are on the deed you can't be forced out, but you can both be forced to sell.
