    Getting served by credit card company
    We are preparing to file for bankruptcy but had been instructed to get our taxes done for 2009 first. In doing so it has taken a lot more time and the delay in the filing of bankruptcy has now landed us a couple of credit card companies serving us with lawsuits.

    I also noticed on the papers being served that they have back dated the document so that we could not possibly respond in the amount of time (20 days) that they are requesting.

    What do I need to do?

    I talked to a bankruptcy lawyer and he said that they will come after our house and file a lien and then come after our wages. Right now we are self employed and there is not much coming in at all, thus we are filing bankruptcy.

    What will happen and where do we go from here??

    You are paying an Attorney who is familiar with the facts and circumstances of your Bankruptcy filing - I would take his/her advice.

    What do the papers say? The time frame runs from the date you are SERVED, not the date the papers were FILED. You have time to respond.

    I don't understand why you have to file your tax returns first.

    I would hurry and file the bankrutpcy. Not sure why he can't file to stop further collections and allow you to get the other paper work prior to hearings.

    If you have some doubts , you may want to get a second opinion from another attorney
