    Claiming children on taxes
    Hi, I am new to this board and hope someone can shed some light on this. My ex and I were divorced in October. In the final decree it is stated that we switch years for filing out only child on our taxes. This would be my year to claim him. My ex is now saying that he was told that we could both claim him as a dependent as we share custody. Is this true?

    A child can be claimed by the person who supplies more than 50% of their support.

    No after the divorce you both can not claim the child, If there is a written decree as to who can and in what years that is the legal binding determination.

    If he violates it, he can be liable for tax penalties and the such when he is caught doing it.
