    PA workmans comp. issue.
    My wife was in an accident while driving our car on company time. She is paid for mileage. At that time she felt fine , she reported it to her superviser. A few weeks later she began having abdominal pain and was
    Diagnosed with a hernia. The doctor felt the hernia was caused by the seatbelt during the accident. She had the surgery to repair the hernia and now can't work for 4 weeks per doctors orders. She asked her superviser
    If this would be a w.c. claim and she stated it was the first she had heard about this. My wife also offered to work in the office if the doctor would allow this and was told they didn't need help in the office.
    Any advice or suggestions would be greatly appreciated.

    The employer wasn't promptly notified of the injury, in other words? That may be a legitimate defense.

    You said she reported this accident to her supervisor. Exactly how did she report this to him?

    Her supervisor does not make the choice, you need to inform them that you wish to make a claim. And you file a claim with workers comp and with their workers comp insurance.

    What State? I agree with AKLawyer - the time to file MAY have expired.

    Need the time frame.
