    How do I evict someone who has lived in my home for ten years.
    I just went to court here in ca. and a judge told me I could not evict this person using a 3 day notice because he has lived there for 10 years. Can anybody tell me how to evict such a person?

    The issue is not how long they have lived there but why you are evicting.

    So
    1. do they have a lease
    2. if no lease is there a written rental agreement

    3.what is the reason you are breaking the rental agreement

    If the eviction is not for non-payment of rent, then in CA you must give them a written notice that their tenancy is terminated and they must move out within 60 days. If they haven't moved out after 60 days then you have to file a lawsuit for eviction.

    Well actually the judge said I was not allowed to use the 3 day notice type eviction so I lost the case today. I'm 83 and its my 54 year old son I'm trying to evict. He put the money down on the mobilehomebut it is in my name because he has bad credit. There is no written agreement between us. I moved out for a while but he has been there the fuill term of use. The reason I'm evicting him is because he is on drugs. Has friends over and I can't stand his girlfriend. I'm old and have several medical problems. I want him in rehab.
