If we can prove that my ex-wife abandoned our children while I was at AIT would the courts be willing to revoke her rights over our children? When I was at AIT she saved up the money she and I were earning while she was living with my parents. Then she told my parents she(a front desk clerk at a hotel) needed to go to NY for a business meeting for 2 or 3 days. She then cleaned out our bank account put it in the negative $500, quit her job and flew to Hawaii. 5 days later no one could get ahold of her, she would not answer their calls. Didn't once call to check on the kids. Finally my mother tracked her down through phone bills and called her number again, where a man answered then gave her her phone. My mother threated her to come back bought her a plane ticket and then she missed her flight. Finally a week and a half later we got her back home. She neglected the children causeing one to be developmentally delayed. She has also allowed the children to wander outside in the road and play with knives and live in filth feeding themselves from the refrigerator at 2 years old. But the only evidence I have is from family that observed and tried to stop the behavior. Would the courts accept witnesses that are my family or will that not since they are my family? Her rights were temporarily suspended when we divorced after she did not show up to court. She was busy getting pregnant by another man who she now has a child with and is gettign child suppoert. She also has not paid child support for almost 2 years. We live in NC. What can we do to get her out of the picture for the safety of our children?

You can use evidence that will be accepted in court to
1. get custody of the children to live with you
2. she will get some level of visits , you can fight for supervised visits.

Why are you waiting, if this is being done, when she left first time ?

The children already live with me, and her visitation rights were suspended but since she didn't show up to court they wouldn't do anything else. She hasn't tried to get her visitation back for the last 2 years so we really weren't worried about anything. But Now she has shown back up and wants her visitation back. But since she put them in danger before we honestly fear for their lives if she is left alone with them. She has mental disorders and was an alcoholic before. Now she is waiting for me to deploy to try to take what she can of the kids while I'm away so we want to show how bad she has been for the kids to try to help my current wife be able to adopt them if we can get her rights taken away. Then we don't risk her getting the kids if I deploy. I don't usually believe in keeping kids from their mother but because she used to leave them with family for un known periods without telling anyone where she was going or when she would be back and never calling to check on them and because when I got my 4 year old from her she hadn't potty trained him or taught him to eat off a table they ate off floors and crawled around playing with butcher knives. I just don't see someone that would treat their kids like animals being given the rights of a parent.

First, I still don't think this is enough to terminate her rights. Courts are very reluctant to issue a TPR. But you should be able to limit her to supervised visitation, at least until she proves herself.

Your best bet is to get an attorney, present your case and see what they say about your chances.
