Not sure where you are at, here we are free to charge what ever amount we want for a deposit that the market will support.

But if you returned it, what can they sue for, since you are no longer holding any extra amount

I am in Michigan. Michgan can not charge more than 1 1/2 month of rent as security deposit. My tenant has bad credit histroy, I refused his application. But he desired to pay me more deposit so he can move in, I agreed. But later I returned the extra deposit to him. Now he sue me and said I violate the Landlord-tenant relation. Any suggestions? Can he sue me? Thank you!

Do you have proof he offered the extra amount?

Yes I do. He wrote me a letter and said that "I desire to pay more money to my landlord".

In that case, he can sue but will lose.
