When your name is on the lease, yes you have a legal right to go back to the house. If he, or his Aunt, does not allow you to, than you call the police dept. or the sheriff and explain. It would be a good idea to have them go with you to the house.

Your name is on the lease so yes you have the right to go back.
Are you talking going back to the apartment or going back to him?

If you're on the lease, then you have a right to go back, but why in the world would you want to?

Why not see an attorney and force him to move out first OR find an apartment all your own?

He was cheating and HE got caught but YOU have to leave? That makes no sense. If you're on the lease, you don't have to leave. HE should move out.

First how long have you been gone, poor taste to go back and he has already moved new girlfriend in.

Have you taken all of your stuff out already ?

He can ask you to leave and since you did, pay no rent and get your own place plus I hope you took what you wanted with you. By law you must have a 30 day notice from the landlord, and if she didn't put it in writing, there is no notice. Spend your money on a good divorce lawyer.
