A N.Y.C. judge terminated my child support payments because my son is 21 years old. Terminated as of 09-01-2009. I owe no arrears, the mother was present in court when it was terminated. Here is aug-16-2010 and she still receiving 400.00 a month from my S.S.D. can I recover this money back. I've always taken care of my son without a court order. I've bought him a new car for his graduation. Please advise?

Did you report the judge's decision to the agency gathering the payments? Too often the right hand doesn't talk to the left hand. The Family Court system and child support collections agencies are separate. While it would make sense for an order terminating support to be sent to the agency, it may not have happened. You should have sent a copy of the order when the Oct 2009 was deducted.

If the agency is still deducting you may have to sue your ex to recover that money.
