You need to ask for a printout from child support enforcement. Also, there was a retroactive child benefit check that should have also gone toward the arrears. Are the arrears a result of not paying while waiting for the decision on SSD? Have you file for a modification on your support? Though unlikely to happen, you should also ask for a retroactive reduction based on the reduction in you income, for the same period your covering your disability. In addition, ask for any interest penalties to be set aside.
No way a retroactive child support modification/reduction to be applied in NYS

Can my husband request that his arrears be decrease or wiped away? He filed for a modification because he apparently can't afford to pay his bills; car payment, cable, cell, netflix, xbox live, zune membership & the list can seriously go on. His current order is $115 a week, full medical which he pays less than $11 for himself & our daughter a week. His arrears goes back to the day the court accepted my petition for child support 10/1/11. Last week the support magistrate informed my husband that the arrears is not associated with the order she put into place & that it's from the local child support enforcement. She explained to him that he would have go to their office & file a petition to get rid of or reduce his arrears. Per the support magistrate his arrears can not be more than 50% of his support order so each week they take $172.50. From 6/2011 until 1/2012 my husband did nothing for our daughter. I was forced to ask for help from family & friends... for food, diapers, milk & clothes. I was paying daycare expenses & medical for myself, my daughter & my husband getting paid 2x a month. So long story short can he even do that without me going along with it?
FYI: I also filed a petition because he was ordered separately to pay 62% of daycare. He made 1 payment in Jan 2012. So now were scheduled to return back to court because he violate that portion of the order.
Thank you!
