    No, he cannot. He hasn't abandoned anything as the child is yet not born.

    Your daughter had an affair with a married man and got pregnant, and now he's going back to his wife?

    Regardless of anything else, this man has an obligation to his child. Take steps to get him established as the legal father.

    Then tell your daughter not to mess with married men.

    I must ask, in the first note it was your baby. From then on, its your daughters.

    There is a sticky note at the top of this forum which deal with the question of abandonment. In this case, your daughter cannot charge the father with abandonment. What she can and needs to do is file for child support. The court will order a paternity test and, if he's the father, will order child support.

    He will have the rights of ANY father so she should also file for full custody. It will be his choice whether to be part of the child's life or not. If he chooses to, he will be able to get visitation.
