You can't take full custody of your niece unless it is court awarded and that doesn't seem very likely as she has a mother. Sorry, not being harsh, but legally you can't take this child. She is her mother's ward until she comes of age and can legally make her own decisions.

If you do take the child in, the mother could press charges against you.

I know this is a bad situation but the only way to work it out is with your sister. Maybe she will agree to a temporary arrangement so you can deal with the middle child's issues.

I could but she just won't listen I have tried for at least 2 1/2 years thanks for the help.
