    I have a car that the credit union charged off
    I have a car that the credit union charged off and filed on their taxes.. when I called them to make arrangement to catch up on the payments, they said they already charged it off. They wanted to repo the car and I gave them my address.. they never came to pickup the car. I called them back and they said they didn't want the car and won't give me an agreement.. but I will not have the title until I pay off the car.. what can I do with the car? I need tags for it... will a car dealership buy the car? What can I do. Its been 4 months now?

    Charging off is a tax maneuver nad has no bearing on your obligation to the debt.

    They are within their rights to refuse to give you the title until you pay off the loan. So you are caught between a rock and a hard place.

    Its not that I want the title.. I know I have to pay the car off... I even informed them that I was willing to make payments on the car... They refuse to work with me.. they are the ones that said they don't want the car (because they could not sell it)... I was willing to give them the car... understand? I asked them do they want me to continue to pay.. they said I can do what I want to do. My question is.. what can I do about this? I am in another state.

    Short of driving the car to their office, walking in and handing them the keys there is nothing you can do. Well you can keep sending in payments and see if they accept them, or save up money to pay it off in one lump sum.

    The write off is merely a tax term, that says they have shown the debt as a loss on the taxes. Does not mean you don't owe the money.

    And no , you can not sell the car, give the car away or do anything with the car until you have the title.

    Assuming you have already licensed the car before, you merely renew your tags, you don't need a title to get your plates once you have registered it.

    Thank you.. that I understand. I am living in another state now, which the tag office said I would need to lien papers, which I don't have to get tags in the state I am in. The credit union said they will not verify that they are the lien holders. I am sure it's their right. I was trying to make right of the wrong I cause because of unemployment and they refuse to work out anything with me. Would the best thing to do is go to the state I have the car license and get the tags. I will still continue to send them monies. The funny thing is that, when I called them to make right.. they said they thought I didn't have the car. I am not understanding why they thought that, because I didn't tell them I didn't have it. Then they said they will put a warrant out for my arrest. Its been almost 4 months now.. I refuse to call them back again, because when I did, they refuse to talk with me.. so what's really going on?

    Are you talking to someone at the credit union or a debt collector? Have you tried talking to a supervisor. This really doesn't make a lot of sense.

    Yes.. I was speaking with the loan manager at the credit union.. not a debt collector.. thats what's I am talking about.. it doesn't make any sense. From working at a bank.. if we charge anyone off.. we still want to recover the money (some if not all) and we were willing to work with people as set up a payment plan... That is why I am not understanding, because they said they don't want to the car and refuse to work anything out with me... It was like I was not speaking with someone in a professional place. Friends I have spoken with, said this sounds weird... it is weird.. To top that, they said they were going to put a warrant out for my arrest, because I didn't have full coverage on car.. I was like how you know that.. you thought I didn't have the car (really don't know how they came to that conclusion) all very real... and again, I was speaking with someone at the credit union.. thats the number that I called and have always called to make payments.

    There is no way they can put a warrant out for your arrest. That's just ridiculous. So try and find someone more senior to talk to.

    I will continue to do that... when I call they keep sending me to this same person. Someone told me I should send them a certified mail letting giving them an option to pick up the car or send me a letter stating they don't want it.. or something.. I don't know... I will keep trying... thanks so much.. But I still believe that they don't have that much on my car... the car dealership that sold me the car is no longer in business... its a major car dealership...
