I got sued a couple months ago by a debt collector for unpaid credit cards. And hired a lawyer who said would take of it and would contact all the creditors to settle my debt (I paid the lawyer). However a Default judgement was granted against me and a different Credit Card case is about to be judged. I just received a letter that I'm in default for not responding personally or through a lawyer, who said he has entered on my behalf! I don't know what to do. I've already paid my lawyer, but it seems like he's not doing anything. Its been almost 3months and all he says he hasn't received any responses from my creditors. What should I do about the pending case and my Lawyer!! Please help!

Can Default judgement be settled after they were granted?

Once a judgment is granted the only way to "settle" it is to pay the amount of the Judgment.

The cc companies do not have to deal with your Attorney and do not have to accept any settlement offers short of the full debt plus interest. This may be the problem - the creditors want to be paid in full.

What did your Attorney send to the creditors - a settlement offer, a notice of appearance, something else?

The person to contact about this is the Attorney.

He said he sent settlement offers and a notice of appearance.. but no body respond to him.. after three months. In regard to the notice of appearance which he said he did. I received another letter that states I don't have representation..

The creditors do not have to deal with him at this point (until you are served) nor do they have to accept his settlement offer. It would appear his offer was not acceptable and, therefore, is being ignored.

A notice of appearance is filed after the lawsuit is started. Is this what happened?

Yes.. the notice of appearance according to him was filed after I was served. But I got a letter from the collection law firm saying I'm in default for not entering a response.

I'd be off the internet and calling the Attorney. He's the one (presumably) with the answers.
