A credit card company filed a statement and proof of claim to collect a credit card debt against the estate of my deceased (87 year old) mother. What little money she had went right to the funeral home. This credit card account had been closed for about 2 years and she was making $100 a month payments. There is no money, there was not enough to pay the full funeral expense. I am her daughter, executor of the estate, but there is no estate. She did not own property, a car, and she lived with me. Can they file such a claim as they just did in our local court house? What can I do? I never co-signed on this debt.

They can file what they want. In the end if there is nothing they get nothing.

Tell them she is deceased,there is no money in the estate and she didn't own anything. If they want to pursue the issue tell them to go ahead cause they will get nothing

Did you probate her estate? If so you should have proof there is nothing left.

First do not give them any of your personal data. Do not talk to them on the phone at all.

Next send them a copy off her death certificate and a statement that there was not enough funds to cover her funeral.

Beyond that, there is nothing they can do, they can try to sue the estate, ( no money) and it is not you.

But under no circumstance at all, that you give them any of your info, so they could try to sue you, don't agree to pay any of the debt yourself at all.
