    Real estate agents knows of defects but, doesn't disclose
    We have a signed purchase agreement. Upon inspection, the roof needs venting. There is mold in the attic. The real estate agent is hoping we back out of the deal because he has another interested party that he is not going to disclose the problem to. What can be done about an agent without any scruples?

    This is a legal question and I have asked that it be moved.

    It is my understanding that you want to go through with the purchase, despite the defects, and you can prove that the real estate agent intend to sell to another party without making full disclosure.

    What State? Laws vary.

    I'm not so sure this is a legal question or an ethics question. So I'm going to leave it where it is for the time being. Your question seems to be what to do about the agent, not what to do about the purchase.

    Real Estate Brokers are licensed. You find the agency in your area that is responsible for such licensing and you report the agent to that agency.

    If you want to know what you should do about going through with the purchase. Get an estimate for fixing the conditions the inspector found. Either require the seller make the repairs before you complete the contract or have the selling price reduced so you can make them.

    Hi, I'm in Michigan. That's exactly what the other agent implied to ours. I think he was using this as a threat or tool to get what he wants. I am hoping that some where out there, real estate agents are being held accountable for their behaviour. We have had people in with estimates. We do not have the $$ yet but, I think the otherside has decided to deny that there are any problems. We really do like the house and my husband is very good at these things, along with professional help. I'm just upset over the attitude of dishonesty coming from the seller side. I appreciate your reply. I really didn't think I would get one, posting here.

    Hi Scottgem, we are seriously considering still purchasing. I guess we are pretty shocked regarding the response to the inspectors findings. In my world their agent should tell them the truth and advise them in an honest manner.

    It is possible the agent was not aware of the problems. Again, if you want the property, then negotiate a lower price.

    By Michigan law the seller or his/her representative must make full disclosure - Michigan's Seller Disclosure Act
