    I am an RN at a very large hospital. I was cut on a cart during a person losing their pulse. I then was required to get a tetanus . Now 4 weeks later I am STILL off work due to an adverse reaction to the vaccination. I have muscle spasms and twitching. I also sleep in excess even on Retalin, which became horrible after the shot. My muscles feel like I ran a 60 mile race every morning I wake up. I was trying to be nice with beginning to file my claim for whatever. I thought my only option was short term but everyone says workmans comp as there were multiple reports about the cart I was cut on needing my tetanus in the first place. How long do you have to file workmans comp? I haven't received a penny from anywhere. WI laws apply. Thank you for your time.

    The waiting period is 7 days. I would certainly file a claim and see how it works out.

    You, of course, need a Physician to state you are disabled due to the after effects of treatment for a work-related injury. Whether the cart needed work is not the problem unless you are planning a lawsuit. Whether you are disabled from a work-related injury is the only issue.

    An Attorney will probably be necessary - NY Workers Comp is not terribly friendly to the employee. I don't know about Wisconsin.

    File for WC and retain a good WC attorney to handle this case. The fact that the cart was already involved with other employee injuries I'm sure a smart attorney will want to sue the cart company and your employer for having such a hazard still on their premises.

    WC does not just automatically kick in. You must fill out paperwork to have it enacted.

    Why did you not file a report when you hurt yourself. But you need to file a workers comp claim,
