Landlord received 60 day notice. I am being sued for past rent. What should I do?
I gave my landlord a 60 day notice about 3 days ago. I have a pending case to be heard in court next month. What should I do? Will the landlord sue me for 60 days because I gave notice or will they just sue for the past month owed?

    Thanks

    1. are you in a lease
    2. are you in a written rental agreement

What type of pending case do you have ?

What is the terms of your rental about moving out.

My lease ended 7 months ago. I gave a written 60 day notice to vacate but I still owe for July's rent. Which they have set a court date for Aug. 3.

So you gave notice that you'd be vacating at the end of September, but you still owe for July rent?

Odds are that you will end up being evicted and owe for the month of July, plus any costs(court costs, attorney fees, etc.) as allowed in your state. Since the case isn't being heard until sometime in August, you'll also owe for the time that you were residing in the apartment during the month of August.

The only way to avoid eviction is to pay July rent in full and then your landlord can dismiss the suit. But the August rent is going to be due in a matter of two days, so if you don't have that money your landlord will probably just file again.
